@Ray Coulter
I don't know of any case authority for that proposition. On the few occasions when prospective clients have asked me to sign NDAs, I have explained that our ethical obligation set forth in California Business and Professions Code Section 6068 (that each attorney must “maintain inviolate the confidence, and at every peril to himself or herself to preserve the secrets, of his or her client” [emphasis added]) is much stronger than the provisions of the typical NDA. That explanation always has sufficed.

Dear Mr. Schultz:

I have been searching (and I'm not a whiz at legal research) for authority for the proposition that a lawyer;s duty of confidentiality is sufficient to protect the client's trade secrets without the lawyer signing an NDA.

Your blog is the only site I found discussing the issue. (And it is an excellent site.) Do you know of any such authority?

Thanks very much for your time in considering my question.

Sincerely, Ray Coulter
